(hereinafter referred to as the “Seller”) 

 

  1. General Provisions

These Terms and Conditions (hereinafter: the “Terms”) govern the relationship between the Seller and the customer (hereinafter: the “Customer”) regarding the purchase of products through the webshop, quotations, showroom purchases, or any other sales channels operated by the Seller. 

The Customer confirms that, prior to concluding the agreement, they have read and accepted these Terms in full: 

  • by placing an online order and confirming the purchase,  
  • by paying a deposit or the full amount,  
  • by signing a quotation, order form, or invoice in the showroom.  

 

  1. Made-to-Order and Custom Products

Most products offered by the Seller are manufactured: 

  • upon the Customer’s request,  
  • according to the Customer’s specifications,  
  • with selected dimensions, materials, colors, finishes, and other characteristics.  

Such products are considered goods made to the consumer’s specifications and clearly personalized products. 

Handcrafted products and natural materials may contain minor imperfections, textural differences, and variations characteristic of the nature of the material and production process, which shall not be considered defects. 

 

  1. Prices

All prices are stated in euros (EUR) and include VAT unless otherwise specified. 

Delivery, installation, and additional services are charged separately unless explicitly stated otherwise. 

The Seller reserves the right to change prices prior to order confirmation. 

 

  1. Orders and Conclusion of Agreement

The agreement between the Customer and the Seller is considered concluded: 

  • online, upon order confirmation and payment completion,  
  • in the showroom, upon signing the quotation, order form, or invoice.  

The Customer is responsible for the accuracy of all submitted information, measurements, and selected specifications. 

After the order is placed, the Customer will receive an order confirmation or quotation by e-mail containing the agreed products and purchase conditions. 

 

  1. Payment

For made-to-order products, the Seller reserves the right to request partial or full advance payment. 

Production begins only after the advance payment or full payment has been received. 

If the Customer cancels the order after confirmation and after production has commenced, the paid deposit is non-refundable. 

 

  1. Production and Delivery Deadlines

Production and delivery timelines are defined during the ordering process or in the quotation. 

All stated deadlines are approximate and may vary due to: 

  • material availability,  
  • manufacturing processes,  
  • logistics,  
  • force majeure,  
  • or other circumstances beyond the Seller’s control.  

The Seller will make reasonable efforts to deliver the order within the agreed timeframe. 

 

  1. Exclusion of the Right of Withdrawal

In accordance with applicable laws and consumer protection regulations, the Customer does not have the right to withdraw from the contract within 14 days for products that are: 

  • made according to the Customer’s specifications,  
  • tailored to the Customer’s personal needs,  
  • personalized or custom-made.  

By confirming the order, the Customer expressly acknowledges and accepts the loss of the right to withdraw from the contract for such products. 

This provision applies to purchases made through the webshop and in the showroom. 

 

  1. Complaints and Material Defects

Upon delivery, the Customer is required to inspect the product and immediately report any visible damage to both the delivery service and the Seller without delay. 

The Customer is entitled to file a complaint only in cases of: 

  • material defects,  
  • manufacturing faults,  
  • transport damage,  
  • delivery of products not compliant with the confirmed order.  

The Customer must notify the Seller of any material defect within two months from the date the defect was discovered. 

Minor deviations in: 

  • color shades,  
  • texture,  
  • patterns,  
  • natural material structures,  
  • product appearance displayed on screens  

shall not be considered product defects. 

Written complaints may be submitted: 

  • in person at the showroom,  
  • by post to the Seller’s address,  
  • by e-mail to info@fabriqa.hr.  

The Seller will respond to the complaint within 15 days from the date of receipt. 

 

  1. Customer Responsibility

The Customer is responsible for: 

  • the accuracy of measurements,  
  • the selection of materials and colors,  
  • all confirmed product specifications.  

Changes after order confirmation: 

  • may not be possible,  
  • or may incur additional charges depending on the production stage.  

 

  1. Showroom and Product Display

Showroom display items serve as reference models and may differ in texture, tone, dimensions, or finish from the final delivered product. 

Product representations in photographs, on screens, and in printed materials may differ from the actual appearance of the product due to screen settings, lighting conditions, and the nature of materials. 

 

  1. Personal Data Protection

Personal data is processed in accordance with the applicable laws of the Republic of Croatia and the European Union regarding personal data protection. 

Detailed information regarding personal data processing, user rights, and the use of cookies is available in the Privacy Policy and Cookie Policy published on the Seller’s website. 

 

  1. Dispute Resolution

These Terms shall be governed by the laws of the Republic of Croatia. 

The parties shall attempt to resolve any disputes amicably. 

Consumers may submit complaints through the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr 

 

  1. Final Provisions

The Seller reserves the right to amend these Terms at any time. 

The Terms valid at the time of the order or purchase shall apply to the Customer.
